Terms of Service

The short version

CrewFlash is a marketplace that connects you with independent local service businesses. We do not perform, supervise, guarantee or endorse their work, and we are not responsible for meetings, disputes, dissatisfaction with work, property damage, theft or loss, injury, or the conduct of customers or businesses. You choose whom to hire and meet, safeguard your property, and agree scope, price and payment directly with the other party. Practical guidance is on the Safety page.

1. What CrewFlash is

CrewFlash operates an online marketplace that lets customers describe a job and be connected with independent local service businesses in the Houston, Texas area and surrounding communities. By creating an account or using the site you agree to these Terms.

CrewFlash provides the platform only. CrewFlash is not a contractor, home-services company, repair shop, moving company, delivery carrier, rental company, staffing agency, employer, insurer, escrow agent, or party to any agreement you make with another user.

2. Independent businesses; no employment, agency or endorsement

Every business listed on CrewFlash is an independent third party operating its own business. CrewFlash does not employ, supervise, direct, control, schedule, train, dispatch, inspect or subcontract them, and no partnership, joint venture, franchise, agency or employment relationship is created between CrewFlash and any user or business.

CrewFlash does not perform, manage, warrant or guarantee any work, delivery, rental, transport or service arranged through the platform. Listing a business, showing it in search results, matching it to a job, or displaying its rating is not an endorsement, recommendation or certification by CrewFlash.

CrewFlash does not guarantee the quality, timeliness, safety, legality, suitability, licensing, insurance, bonding, certification, identity, honesty, background, workmanship or outcome of any business, customer, job, listing, review or communication, except for a specific, limited verification that CrewFlash expressly displays. Where CrewFlash shows a verified badge, that badge means CrewFlash has checked identity and contact details only, and nothing more.

3. Your responsibilities

You are responsible for deciding whom to contact, hire, meet, admit to your property, or perform work for. You are responsible for evaluating a business or customer yourself, including requesting and independently confirming licenses, insurance, permits, references and credentials with the issuing authority or insurer.

You and the other user agree directly on scope of work, materials, schedule, price, payment method, deposits, change orders, warranties, cancellation and any other term. CrewFlash is not a party to and does not enforce those agreements, and does not process payments between users.

You are responsible for safeguarding your property, valuables, vehicles, pets, data and personal information, for supervising your premises, for taking reasonable precautions before and during any in-person meeting, and for complying with all applicable laws, licensing requirements, tax obligations and insurance requirements that apply to you or your business.

You agree to provide accurate information, not to impersonate anyone, not to post false or misleading listings, jobs or reviews, not to harass or discriminate, and not to use CrewFlash for unlawful purposes.

4. Assumption of risk for meetings and work

Using a marketplace to meet, admit to your property, hire, or work for people you do not know involves risk. To the fullest extent permitted by Texas law, you knowingly accept that risk and agree that CrewFlash is not responsible for what happens between users, whether online, by phone, at a property, in a vehicle, or anywhere else.

This includes, without limitation: in-person meetings and site visits; disagreements over scope, price, timing, quality or payment; dissatisfaction with completed or abandoned work; damage to real or personal property; theft, loss, disappearance or damage of money, tools, materials, vehicles or valuables; bodily injury, illness or death; harassment, misconduct, fraud, or criminal conduct; and any other act or omission of a customer, business, employee, subcontractor, or other third party.

Nothing in these Terms is intended to disclaim liability that cannot be disclaimed under Texas law, including liability for CrewFlash's own gross negligence, recklessness or intentional misconduct.

5. Disputes between users

Disputes arising from a job, quote, agreement, payment, meeting or completed work are solely between the customer and the business. You will pursue them directly with the other party or through the remedies otherwise available to you, such as your own or the other party's insurance, a licensing board, a consumer protection agency, mediation, or a court of competent jurisdiction.

CrewFlash has no obligation to investigate, mediate, arbitrate, indemnify or resolve a dispute between users, and cannot recover property or award compensation. CrewFlash may, at its discretion, remove content, restrict features, and suspend or terminate accounts on its platform, and may cooperate with law enforcement where required or appropriate.

You release CrewFlash, its owners, officers and personnel from claims, demands and damages of every kind arising out of or connected with a dispute with another user, to the fullest extent permitted by Texas law.

6. Reviews, reports and content

Reviews may only be submitted following a genuine interaction with the business reviewed through CrewFlash. Reviews must be truthful and based on your own experience. Incentivised, fake, retaliatory, defamatory or off-topic content is prohibited.

You are responsible for content you post, including job descriptions, photos, listings and messages, and you confirm you have the rights to post it. CrewFlash may remove content that violates these Terms or the law but does not pre-screen or endorse user content and is not responsible for its accuracy.

You can report a business, customer, job or review from its page, and block another user from contacting you.

7. Location and address information

Job listings shown to businesses display a general area — town, neighbourhood and ZIP code — rather than your exact street address. Your full address becomes available to a business only through the job flow, after you share it or hire that business. Once you share your address or other contact details with another user, CrewFlash cannot control how they use or retain that information.

8. Disclaimer of warranties and limitation of liability

To the fullest extent permitted by Texas law, CrewFlash provides the platform on an “as is” and “as available” basis and disclaims all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding businesses, customers, listings, matching, availability, or uninterrupted or error-free operation.

To the fullest extent permitted by Texas law, CrewFlash and its owners, officers and personnel will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, loss of use, property damage, theft or loss of property, or personal injury, arising out of or relating to the platform or to any interaction, agreement, meeting or work between users.

To the fullest extent permitted by Texas law, CrewFlash's total aggregate liability for all claims relating to the platform is limited to the greater of the amount you paid CrewFlash in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars (US$100). CrewFlash is currently free to use for customers and for businesses on the free tier.

Some limitations may not apply to you. If a provision of this section is found unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions stay in effect.

9. Indemnity

To the fullest extent permitted by Texas law, you agree to indemnify and hold CrewFlash and its owners, officers and personnel harmless from claims, damages, losses and reasonable legal fees arising from your use of the platform, your content, your agreements or interactions with other users, your work or property, or your violation of these Terms or of applicable law.

10. Accounts, pricing and changes

You are responsible for the security of your account and credentials. CrewFlash may suspend or terminate accounts that violate these Terms.

CrewFlash is free for customers. Businesses can list on the free tier. CrewFlash Pro is announced as coming soon; no payments are processed on the platform today, and any future paid features will be described before they take effect.

CrewFlash may update these Terms. Material changes will be reflected by a new effective date on this page, and continued use after that date means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. The exclusive venue for disputes with CrewFlash is the state or federal courts located in Harris County, Texas, to the extent permitted by law.

These Terms are written in good faith as a reasonable marketplace agreement, but they are not legal advice and have not yet been reviewed by an attorney. Texas law limits how far any platform can disclaim responsibility, and some provisions here may be narrowed or unenforceable. CrewFlash should have a licensed Texas attorney review and adapt this document before relying on it as final legal protection.
